These terms do not remove consumer rights or other protections that cannot lawfully be excluded.
1. The website
The December Company is an independent creative project operating from Bengaluru, India. The website publishes cultural and editorial work, operates moderated correspondence, accepts enquiries and sells the physical product shown in the shop.
2. Eligibility
You may browse public material at any age. You must be at least 18 to use Reply Room Pilot 001. Project briefs must be submitted by someone authorised to discuss the proposed work.
3. Acceptable use
- Do not break the law, impersonate another person or interfere with the site’s operation.
- Do not scrape, probe, overload, reverse engineer or bypass access, moderation or security controls.
- Do not submit harassment, threats, unlawful discrimination, exploitation, spam, malware, private information without permission or content that creates a credible safety risk.
- Do not use TDC material or participant correspondence to train, populate or market an automated system without written permission.
4. TDC material
Unless stated otherwise, the site’s writing, visual identity, photographs, films, graphics, product designs, concepts as expressed, selection and arrangement are owned by or licensed to TDC. You may link to public pages and quote short portions for genuine commentary with attribution. You may not reproduce, sell, republish, adapt or commercially exploit substantial material without written permission.
5. Your submissions
You retain ownership of material you submit. You give TDC a limited, non-exclusive permission to store, review, redact, format, transmit and reproduce it only as reasonably needed to operate the feature you selected, respond to you, keep necessary records, protect safety and comply with law.
TDC will not publish a private Reply Room letter as editorial content without separate permission. You confirm that you have the right to submit the material and that doing so does not unlawfully violate another person’s rights.
6. The Reply Room
The Reply Room is a moderated creative correspondence experiment. TDC may accept, decline, delay, redact, reassign or close a submission. A reply is not guaranteed, and TDC does not guarantee its tone, usefulness or timing. TDC may withhold a reply that appears unsafe or violates these terms. Response invitations are private, ordinarily expire after 14 days and may be closed after one completed response.
The Reply Room does not provide therapy, crisis response, medical care, legal advice or professional counselling. If you or someone else is in immediate danger, contact an appropriate local emergency or crisis service.
7. Products, payments and events
Product availability, price, taxes, shipping eligibility, production time and any specific exceptions are shown before checkout. An international-order form, object-interest registration or custom enquiry is non-binding and does not reserve stock or create a sale. A contract arises only when TDC confirms acceptance and, where applicable, receives payment.
Separate shipping, return, event or product-specific terms form part of the purchase. If there is a conflict, a clearly disclosed product-specific term controls for that purchase, subject to mandatory law.
8. Third-party services
The site may link to or rely on third-party hosting, payment, delivery or social services. Their own terms and privacy practices apply to their systems. A link does not imply endorsement of everything on that service.
9. Editorial information
TDC material is cultural commentary and creative work, not individual medical, legal, financial or other professional advice. Although we try to correct material when appropriate, the site may contain opinion, uncertainty, errors or information that later changes.
10. Responsibility and liability
To the fullest extent permitted by law, TDC is not responsible for indirect or consequential loss arising solely from free website use, third-party systems, unauthorised misuse or events outside reasonable control. Nothing in these terms excludes liability that cannot lawfully be excluded, including applicable consumer protections or liability for fraud or wilful misconduct.
11. Suspension and changes
TDC may suspend a feature, remove material, restrict misuse or close a finite pilot. We may update these terms prospectively by publishing the revised date. Material changes affecting an active paid relationship will be communicated where reasonably required.
12. Law, disputes and contact
These terms are governed by the laws of India. Courts with jurisdiction in Bengaluru, Karnataka will ordinarily have jurisdiction, subject to any consumer forum or other forum you are legally entitled to use.
